The core duty: a pest-free, habitable home

Under the Housing Maintenance Code and Local Law 55, a habitable apartment must be safe, sanitary, and free of pests — mice, rats, roaches, and insects — and owners must address the conditions that cause infestations using safe, Integrated Pest Management practices. The Health Department confirms property owners are legally required to keep rats out, and its guidance for building owners sets the expectations.

Bed bugs: disclosure and the 30-day clock

Local Law 69 requires owners of multiple dwellings to file an annual bed bug report with HPD and provide a written bed bug disclosure (building and unit history) to every tenant at lease signing and renewal. Bed bugs are an HPD Class B violation that must be corrected — generally within 30 days. Who pays — and tenant protections

For building-wide and unit conditions that aren’t tenant-caused, the owner is responsible for the cost of remediation. Tenants are also protected from retaliation for reporting pests to HPD — an owner can’t lawfully retaliate with eviction, non-renewal, or a rent increase for a good-faith complaint.
