If you own or manage a building in New York City, pest control is a legal obligation, not a convenience. The City places the duty squarely on owners and boards, backs it with inspections and violations, and — in a growing number of neighborhoods — with Rat Mitigation Zone enforcement. Under the NYC Housing Maintenance Code and Local Law 55, owners must keep dwellings and common areas free of pests and the conditions that attract them, inspect for them, and respond to complaints. The Health Department is explicit that property owners are legally required to keep rats out. In practice that means tenants generally do not pay for building-wide pest control — the owner does.
Local Law 69 of 2017 requires owners of multiple dwellings to file an annual bed bug report and to give every new and renewing tenant a bed bug disclosure for the building and unit. Bed bugs are also an HPD Class B (“hazardous”) violation that the owner must correct, typically within 30 days. The City has designated Rat Mitigation Zones — high-activity areas (Harlem, Chelsea, the Grand Concourse, parts of Brooklyn) where enforcement is concentrated — and Local Law 31 phases in commercial waste containerization to cut off food sources. Owners in these zones face heightened inspection and need active, documented rodent control.
