If you own or manage a building in New York City, pest control is a legal obligation, not a convenience. The City places the duty squarely on owners and boards, backs it with inspections and violations, and — in a growing number of neighborhoods — with Rat Mitigation Zone enforcement. This guide explains the laws that matter and how a documented program keeps you on the right side of all of them. Under the NYC Housing Maintenance Code and Local Law 55, owners must keep dwellings and common areas free of pests and the conditions that attract them, inspect for them, and respond to complaints. The Health Department is explicit that property owners are legally required to keep rats out. In practice that means tenants generally do not pay for building-wide pest control — the owner does.

Bed bugs: Local Law 69 and HPD violations

Local Law 69 of 2017 requires owners of multiple dwellings to file an annual bed bug report and to give every new and renewing tenant a bed bug disclosure for the building and unit. Bed bugs are also an HPD Class B (“hazardous”) violation that the owner must correct, typically within 30 days. Rats: Mitigation Zones and Local Law 31

The City has designated Rat Mitigation Zones — high-activity areas (Harlem, Chelsea, the Grand Concourse, parts of Brooklyn) where enforcement is concentrated — and Local Law 31 phases in commercial waste containerization to cut off food sources. Owners in these zones face heightened inspection and need active, documented rodent control. Food businesses in your building: the letter grade

If your building houses a restaurant or food retailer, their DOH letter grade depends on pest conditions too — a single live cockroach is a 28-point violation. See DOH letter-grade protection and commercial pest control.

What is Local Law 55?

It requires owners to keep dwellings free of pests and the conditions that attract them, and to use safe, Integrated Pest Management practices. We build programs to that standard.

What does Local Law 69 require?

An annual bed bug filing and a disclosure to tenants of the building’s and unit’s bed bug history. Documented treatment keeps that disclosure grounded in fact.

What happens if I get an HPD violation?

Class B pest violations (including bed bugs) must be corrected, usually within 30 days. We prioritize these and document the correction. See building pest control.

What are Rat Mitigation Zones?
