In a New York City building, pests are a governance problem before they are a biology problem. Under the City’s Housing Maintenance Code and NYC Health Department rules for building owners, boards and owners must keep the premises free of mice, rats, roaches, and other pests, inspect for them, and respond to complaints. When a shareholder reports roaches or a bed bug shows up in one line of apartments, the board — not the resident — owns the outcome. Pests spread along shared infrastructure — risers, trash chutes, wall voids, and the compactor room — so a “unit problem” is almost always a building problem. Two areas carry the most liability: rodents, where the City expects active control and exclusion, and bed bugs, which are a Class B violation and carry an annual disclosure duty to residents.
